Donald Trump boldly announced his intent to undertake the greatest mass deportation in the nation’s history. His nominee for Border Czar, Thomas Homan, made clear in a recent 60 Minutes interview that a key aspect of the plan to identify and deport undocumented workers will be a massive uptick in I-9 audits.
Employers in the restaurant, manufacturing, landscaping, construction, warehousing, assembly, tooling, and staffing industries will likely feel the brunt of the Trump enforcement initiative. White collar companies dependent on H-1B professional service workers can expect increased worksite immigration fraud inquiries and DOL investigations.
All employers should be alert to the possibility of investigations by the Trump Justice Department seeking evidence of unlawful favoritism toward foreign nationals in recruitment, hiring, and retention policies and procedures.
