USCIS Ombudsman Maria Odom, Mary Pivec, partner in FordHarrison’s Business Immigration Group, Denise Rahmani, head of Oracle’s Immigration program, Lynden Melmed, former Chief Counsel at USCIS, and now a partner at BALGlobal, will discuss the USCIS Administrative Appeals Office precedent decision Matter of Simeio Solutions LLC. Under this new decision, which is binding on all USCIS adjudication officers, a move of an H-1B employee to a different geographical area may constitute a material change requiring the filing of an amended H-1B petition supported by a new Labor Condition Application. This decision changes the agency’s prior interpretations of when an amended petition is required.
